Please read the provisions of this Freeware Licence carefully before you download the archive "TRONOrderXML version 2.1.4" ("Interface Protocol") and use the files contained therein. Through the downloading and unpacking of the files, you consent to the following licence provisions for the use of the Interface Protocol "Transfer Ordering Network Protocol (TRON)". Should you not be in agreement with the following provisions, all further use (downloading, unpacking, application and use) must cease.

No. 1 General provisions and definitions

a) Freeware
The Interface Protocol is marketed and licensed for use as freeware through this Licence. The Licence is granted free of charge and does not give the user the authorizations of a public domain software licence.

b) Contents of the Interface Protocol archive ("tron.zip")
The archive of the Interface Protocol offered for downloading includes all components in the area "Developer Zone" on this Website ( http://www.ecce-terram.de/index.php?id=153). All this componence are licence under this agreement.

c) Licensee
Licensee: Natural or legal person (company) who uses the Interface Protocol in the described manner.

d) Private use
Private use: The exclusive use of the Interface Protocol in the private sphere of a natural person or a charitable organisation for non-commercial purposes.

e) Commercial use
Commercial use: The predominant use of the Interface Protocol by a natural person, a company or another organisation for the purpose of achieving profit.

f) Reproduction
Reproduction of the Interface Protocol archive: Any storing of the archive files on independent and marketable data media (floppy disks, hard disk, CD, DVD), including via the Internet or other data and communication networks.

g) Circulation
Circulation: The public dissemination or offering of the Interface Protocol archive.

h) Provision of public access
Provision of public access: The holding of the Interface Protocol archive available for interactive retrieval via the Internet or other data and communication networks.

i) Processing, alterations, extensions and implementation (modifications)
Modifications: Any transfer of the depicted functions of the Interface Protocol into any programming language, translation of the draft material into object or source codes and the supplementation or extension of the Interface Protocol, integration of the Interface Protocol into client or server applications (implementation).

j) Client and server applications
Client application: Any software which accesses resources of a server through a network link and reloads these into the memory of the computer on which the client application is located. Server application: Any application which makes data, for instance from a data base, available to a client application.

No. 2 Licence for private use in client and server applications

The Licensor grants the Licensee the non-exclusive license, free of charge and unrestricted as to territory and time, for the private use of the Interface Protocol in client and server applications. This includes the deployment (use), depiction, reproduction, circulation and the provision of public access of the Interface Protocol via the Internet or other data networks. The Licence covers all types of use known at the time of the consent.

No. 3 Licence for commercial use in client applications

a) Use in client applications
The Licensor grants the Licensee the non-exclusive license, free of charge, of commercial use of the Interface Protocol in client applications according to scope of the provisions contained in No. 2.

a) Use not permitted in server applications
The Licensee is not permitted to make commercial use of the Interface Protocol in server applications. For commercial use in server applications, a separate licence must be obtained from the Licensor.

No. 4 Modifications

a) Commercial use in client applications
The Licensee is not permitted to modify the Interface Protocol for commercial use in client applications.

b) Private use in client and server applications
The Licensee is permitted to modify the Interface Protocol and to use the revised Interface Protocol for private purposes in client and server applications. The Licensee is not entitled to use the designation "Transfer Ordering Network Protocol (TRON)" for the modified Interface Protocol; he is, however, nevertheless obliged to draw corresponding attention to the fact that the "Transfer Ordering Network Protocol (TRON)" forms the basis thereof.

c) Suggestions to the authors for the modification of the Interface Protocol
The authors of the Interface Protocol are pleased to receive suggestions of licensees for the modification of the Interface Protocol. Corresponding communications should be directed to the e-mail address trondev@ecce-terram.de.

No. 5 Naming of the Licensor; Designation "Transfer Ordering Network Protocol (TRON)"

Within the scope of the use, the right of reproduction, the right of circulation, the provision of public access and modification in accordance with Nos. 2, 3 and 4 of this Freeware Licence, the Licensee is obliged to name the Licensor as the owner of the rights to the Interface Protocol, and may not remove the corresponding notices. The Interface Protocol archive ("tron.zip") may only be reproduced, circulated and published in its original condition and with all components appertaining thereto. The Licensee is prohibited from removing, altering or making any other use of the text file of this Licence.

No. 6 Warranty and support

a) No warranty
The use of the Interface Protocol is at the own risk of the user. The Licensor gives no warranty for the Interface Protocol within the scope of this Freeware Licence or the statutory provisions.

b) No support
Based on the fact that the Licence is granted free of charge, the Licensor does not assume or offer any support for the Interface Protocol. Reference is made to No. 5. letter c) of this Licence. However, under www.ecce-terram.de in the area eccePhoto / Developer Zone, a forum and/or mailing list will be set up in the near future for the mutual exchange of experience and support.

No. 7 Term and termination of the Licence

a) Term
This Freeware Licence is granted for a period unlimited in time within the framework of No. 7 letter b) for client applications.

b) Termination of the Licence by the Licensee
The Licensee may terminate this Licence by completely and permanently deleting the Interface Protocol archive and the files contained therein and ceasing further use.

c) Termination or amendment of the Licence by the Licensor
In so far as permissible by law, the Licensor reserves the right to terminate or amend this Freeware Licence for private use in server applications, subject to observing a reasonable period of notice publicised on www.ecce-terram.de.

No. 8 Soap
Parts of the illustrative programmes as reference implementations of the Interface Protocol are based on SOAP::Lite (Perl), NUSOAP (PHP) or gSoap (C/C++). When using these illustrative programmes in own software, the corresponding licence provisions of the owners of these rights are to be observed.
